Subramanyam "Subu" Vedam's immigration case has been ordered reopened, blocking an attempt by the federal government to deport him.
Vedam served more than 40 years in prison after being found guilty of first-degree murder. However, his conviction was vacated in August, and in October, Centre County District Attorney Bernie Cantorna announced he wouldn't retry the case. Upon Vedam's release from state prison in October, he was immediately taken into U.S. Immigration and Customs Enforcement custody, the Centre Daily Times previously reported.
The U.S. Department of Homeland Security was trying to remove Vedam from the country with a decades-old deportation order.
Two courts ordered officials not to deport him until the Board of Immigration Appeals decided whether to take up his case, the Associated Press reported in early November.
In his February order granting Vedam's motion to have his immigration case reopened, Temporary Appellate Immigration Judge Paul A. McCloskey wrote: "Given the facts and circumstances in this particular case, we conclude that the record before us presents an exceptional situation."
The CDT reports that the ruling restores Vedam's permanent U.S. residency and "paves the way for a new hearing, effectively blocking ICE's efforts to deport him."
Vedam, 64, was brought legally as an infant to the United States from India and was raised in State College, the newsroom reports.
According to a press release, Vedam's lawyers plan to ask for his release on bond from the Moshannon Valley Processing Center in Clearfield County.
